Terms & Conditions

1. General / Applicability

1.1 These terms and conditions apply to all offers, orders and agreements of HeyCurls. These terms and conditions are accessible to everyone and are included on the HeyCurls website.

1.2 By placing an order you acknowledge that you agree with the delivery and payment terms.

1.3 Unless otherwise agreed in writing, the general or specific terms and conditions of third parties are not recognised by HeyCurls.

1.4 HeyCurls reserves the right to make amendments to its terms and conditions at all times. 

1.5 HeyCurls  is registered at the CoC under number 77533402. Our VAT number is: NL8610.37.935B01.

 

2. Agreement

2.1 An agreement between HeyCurls and a customer is established after an order is placed and a confirmation is received via the specified email address. 

2.2 HeyCurls can refuse or attach certain conditions to the delivery, unless explicitly stated otherwise. If an order is not accepted, HeyCurls communicates this within 10 days of receipt of the order.

 

3. Offers

3.1 Offers are not binding unless otherwise stated.

3.2 Offers are subject to the availability of the products.

3.3 HeyCurls has the right to modify or cancel the offers without prior notice.

3.4 HeyCurls is not bound by its offer if the customer could reasonably understand that the offer or any part thereof was an obvious mistake or error.

 

4. Prices

4.1 All prices on the site are subject to misprints. No liability is accepted as a consequence of misprints

4.2 All prices on the site are in Euros and inclusive of 21% VAT. Shipping is not included in the price.

4.3 HeyCurls is entitled to adjust the prices. Potential price changes will not be applied, if the customer already completed the order.

4.4 If the customer is not located in the EUROZONE, the customer is responsible for any taxes and duties that its country has.

 

5. Payment

5.1 The customer can pay the amount due by way of electronic payment.

5.2 In the absence of a timely payment, HeyCurls is entitled to cancel the order and there is no agreement reached.

 

6. Delivery

6.1 The website’s delivery times are indicative. The indicated delivery times are therefore not legally binding.

6.2 HeyCurls strives to achieve the indicated delivery times as stated on the website.

6.3 Delivery takes place only after payment is received by HeyCurls.

 

7. Right of withdrawal

7.1 The customer has the right to return (part of) the goods within 30 days of receipt if:

1. contact was sought with HeyCurls first.
2. the products are unused, undamaged, unopened and in the original packaging.
3. the customer assumes responsibility for the shipping charges and the  transit risk until the package has arrived at HeyCurls.

7.2 Taking into account Article 7.1, HeyCurls ensures that the purchase price will be refunded to the customer, within 14 days after receipt of the return.

7.3 HeyCurls reserves the right to refuse returns if the products are not received in good order and is entitled to bring on charges.

 

8. Force Majeure

8.1 HeyCurls is not liable if and when she can not fulfil her obligations due to force majeure.

8.2 Force majeure shall mean any strange reason, and any circumstance which Natural Heroes can not reasonably be held responsible for. Delay or failure by our suppliers, disruptions in the internet, electricity failures in email traffic and disturbances or changes in third-party technology, transportation difficulties, strikes, government measures, delays in supply, omissions of suppliers and / or manufacturers of HeyCurls as well as from individuals, disease, shall explicitly count as Force Majeure.

8.3 In case of Force Majeure, HeyCurls reserves the right to suspend its obligations and is entitled to dissolve the agreement in whole or in part, or to claim that the content of the agreement is amended so that processing can continue. In no event shall HeyCurls be obliged to pay any penalty or damages.

 

9. Guarantee

9.1 The warranty period as determined by the manufacturer of the product applies to all products of HeyCurls

9.2 This warranty does not apply if: A) and as long as the customer is failing to meet obligations; B) the customer repaired or modified the delivered goods or commissioned third parties to do so; C) the products are exposed to abnormal conditions or otherwise handled carelessly or contrary to the instructions on the packaging.

 

10. Liability

10.1HeyCurls is not liable for damage to property caused by improper use of the products.

 

11. Complaint

11.1 The customer is obliged to check the delivered products immediately upon receipt. If it transpires that the delivered product is incorrect, inadequate or incomplete, the client must (before proceeding to return to HeyCurls) notify the customer of HeyCurls.  Any defects of delivered products should be reported by email within 5 days after receipt. Returns must be in their original packaging and in new condition. Use of the defected products after detection, damage occurring after detection, or resell after detection, revokes the right to complain and return the goods.

11.2 The customer is responsible for the shipping charges and for the transit risk until the package is received by HeyCurls.

11.3 If it appears that after examination by HeyCurls, the products do not comply with the contract, the customer is entitled to a replacement, if still available, or a refund of the purchase price.

 

12. Data

12.1 If you place an order with HeyCurls, your data will be included in the customer base of HeyCurls. HeyCurls adheres to the Data Protection Act and will not provide your information to third parties. See our Privacy Policy.

12.2 HeyCurls respects the privacy of the users of the website and ensures confidentiality of your personal information.

12.3 HeyCurls sometimes makes use of a mailing list. Each mailing includes instructions to remove yourself from this list.
